Maksekeskus Terms

1. Applicability of General Terms and Conditions

1.1 The general terms and conditions of AS-i Maksekeskus (hereinafter Maksekeskus) apply to all legal and natural persons (hereinafter the Client or Clients) who use the Maksekeskus service (hereinafter the Service).

1.1.2 The general terms and conditions can be found on the Payment Centre's website (hereinafter referred to as the Payment Centre environment). www.maksekeskus.ee.

1.2 Establishment and Amendment of General Terms and Conditions

1.2.1 General terms and conditions are set by Maksekeskus.

The payment centre has the right to amend the general terms and conditions unilaterally.

1.3 Applicable law and dispute resolution

1.3.1 Relations between the Payment Centre and the Client are governed by the laws of the Republic of Estonia.

1.3.2 Disputes between the Payment Centre and the Customer shall primarily be resolved through negotiation.

1.3.3 If disagreements cannot be resolved, the interested party has the right to submit a complaint or claim in writing to the other party.

1.3.4 The claim must indicate the fact that caused the claim to be submitted and attach documents proving the claim.

1.3.5 If negotiations fail, disputes shall be settled by the Harju County Court.

1.3.6 Oversight of Maksekeskus's activities in relation to cash payment services is carried out by the Financial Supervision Authority. More detailed information about the Financial Supervision Authority is available on their website. www.fi.ee.

1.4 The service provided by the Payment Centre (Service)

1.4.1 Maksekeskus shall, within the Maksekeskus environment, facilitate payment methods offered by providers of various payment methods, through which Customers can make payments.

1.4.2 Maksekeskus offers a cash payment service, through which Customers can make payments.

1.5 Client data processing

1.5.1 Client data processing objectives:

1.5.2 Maksekeskus shall process the personal data disclosed by the Client as follows:

1.5.2.1 personal data (client name, personal identification code, date of birth, details of identity document, etc.) for the purpose of identifying the person and for transferring to instalment payment providers and for applying for/obtaining instalment payments, if the client has selected instalment payments as the payment method;

1.5.2.2 contact details (phone number, address, e-mail address, etc.) for identifying the person and for forwarding to instalment providers for the purpose of applying for/obtaining an instalment, if the Client has chosen instalment as the payment method.

1.5.3 Processing of the Client's personal data in the ways specified in points 1.5.2.1 and 1.5.2.2 is necessary for the purpose of deciding on the conclusion of an agreement with the Client, managing and fulfilling the concluded agreement, fulfilling obligations established by law, and protecting one's violated or disputed rights.

1.6 Responsibility

1.6.1 The Payment Centre and the Client shall fulfil their respective obligations properly, in good faith, reasonably, observing the requirements of due diligence, and taking into account customs and practice.

1.6.2 Maksekeskus and the Client shall not be liable for a breach of obligation if it is caused by force majeure. Force majeure means circumstances that the obligated party could not influence.

1.6.3 Maksekeskus a/s shall have no liability whatsoever for any product/service/goods etc. for which the Client pays using the Service.

1.6.4 Maksekeskus shall not deal with or respond to any claims arising from clause 1.6.3.

1.6.5 To use the Service, the Client is obliged to enter correct data. The Client is responsible if the data entered by them is inaccurate or incorrect.
